TERMS AND CONDITIONS OF SALE

ARTICLE 1 – Scope of Application
These Terms and Conditions of Sale (T&C) apply to all sales made by GEEKEURE (sole proprietorship) to non-professional consumers via the website https://geek-eure.fr.
Products covered:
New and used video games, consoles, figurines, board games, trading cards (TCG), merchandise, and related products.
The customer acknowledges having read the product descriptions (condition, used item notes, pre-orders, dates, etc.) prior to placing any order.
The choice and purchase are the customer’s sole responsibility.
The Terms and Conditions are available at all times on the website and are accepted upon order confirmation.

TERMS AND CONDITIONS OF SALE
Effective as of January 25, 2022
ARTICLE 1 – Scope of Application
ARTICLE 2 – Prices
Prices are listed in euros, inclusive of tax, excluding shipping costs.
Processing and shipping fees are displayed before the order is confirmed.
The seller reserves the right to modify its prices at any time, except for orders that have already been confirmed.
ARTICLE 3 – Orders
Any order placed on the website constitutes a distance sales contract upon full payment.
In the event of a stock error, inventory discrepancy, or simultaneous sale in-store or at a convention, the seller reserves the right to:
cancel the order,
or refund only the unavailable item within 72 hours.
Pre-orders
If an order contains both available items and pre-orders, the entire order will be shipped in a single package on the date the pre-orders become available.
ARTICLE 4 – Customer Account
Creating an account is required to place an order.
The customer is responsible for the confidentiality of their login credentials.
The seller reserves the right to suspend or delete an account in the event of non-compliance with the Terms and Conditions.
ARTICLE 5 – Payment
Payment is due immediately upon ordering, by credit card via a secure system.
No shipment will be made until payment has been received.
ARTICLE 6 – Delivery
Orders are shipped to mainland France and Europe within 48 to 96 hours after preparation (excluding Sundays and public holidays).
Unless otherwise stated on the product page or pre-order page.
Free delivery is available for in-store pickup in Conches-en-Ouche.
📦 ARTICLE 7 – Receipt of Packages
The customer must check the condition of the package upon delivery.
If the package is damaged, opened, crushed, or appears suspicious, the customer must:
refuse the package, or
make specific and detailed reservations on the carrier’s delivery slip.
⚠️ General remarks such as “subject to unpacking” have no legal validity.
In accordance with Article L133-3 of the French Commercial Code, any package accepted without reservation is deemed to be in good condition.
In this case, no claims, exchanges, or refunds may be demanded for damage related to shipping.
Sealed products (TCG, collectibles, collectible items) are shipped new and sealed in their original manufacturer’s packaging.
We cannot be held liable for damage caused during shipping.
It is also worth noting that sealed products may sometimes have a seal that is slightly damaged; this does not constitute grounds for a return, as the products are intended to be opened in the first place. We receive and ship products in the same condition as when we received them from our suppliers.
A goodwill gesture may be offered without admission of liability.
ARTICLE 8 – Right of Withdrawal
The customer has 14 days from the date of receipt to exercise their right of withdrawal (form at the bottom of the page).
Returns must be complete, in perfect condition, and in their original packaging.
Return shipping costs are the customer’s responsibility.
❌ Products excluded from the right of withdrawal:
perishable items,
used products,
sealed booster packs and TCG products,
customized items,
pre-orders after the legal deadline has expired.
ARTICLE 9 – Warranties
New Products
Legal warranty of conformity and warranty against hidden defects.
Used products
Products tested before sale.
Warranty:
3 months for used consoles,
14 days for used games.
Any misuse or damage caused by the customer voids the warranty.
For returns due to a defective item only, we will send you a return form; the refund will be issued after verification of the item’s condition.
ARTICLE 10 – Personal Data
Data is collected solely for the purpose of processing orders.
In accordance with the GDPR, the customer has the right to access, modify, and delete their data.

All content on the website is protected.
Any reproduction is strictly prohibited.
ARTICLE 12 – Governing Law and Disputes
These Terms and Conditions are governed by French law.
In the event of a dispute, an amicable resolution will be sought.
Failing that, jurisdiction is assigned to the courts of Évreux.
